12. Delivery, Logistics and Transfer of Risk

CADS reserves the right to determine the most appropriate delivery method for each order or shipment.

Where an order includes products supplied from different fulfillment locations or suppliers, CADS may deliver the products in separate shipments. The customer acknowledges and agrees that a single order may result in multiple deliveries made at different times and that such partial deliveries do not constitute a failure to perform the contract.

Delivery times displayed on the website or communicated to the customer are estimates only and are provided for informational purposes. Such estimates do not constitute guaranteed delivery dates and may be affected by factors including, without limitation, carrier capacity, customs procedures, inspections, weather conditions, port or airport congestion, regulatory controls, or other circumstances beyond the reasonable control of CADS.

The customer is responsible for providing accurate, complete, and accessible delivery information, including a valid delivery address and any instructions necessary to ensure successful delivery. CADS shall not be liable for delays, failed deliveries, or additional costs resulting from incorrect, incomplete, or inaccessible delivery information, or from the absence or unavailability of the recipient at the time of delivery.

Unless expressly agreed otherwise, delivery is performed at ground level or curbside. Delivery does not include unloading, installation, assembly, handling with special equipment, or any other ancillary services. Where products are heavy, bulky, or require special handling or equipment for unloading, the customer is solely responsible for ensuring appropriate access, equipment, and personnel at the delivery location.

The customer is required to inspect the products upon delivery and to report any visible damage, missing items, or discrepancies at the time of delivery, in accordance with the carrier’s procedures. Failure to note such issues at the time of delivery may result in the rejection of related claims.

For international deliveries, the customer is solely responsible for complying with all applicable import, customs, tax, and regulatory requirements in the destination country. Any customs duties, import taxes, local taxes, fees, or charges imposed by authorities in the destination country shall be borne by the customer, unless expressly stated otherwise.

The customer acknowledges that certain products may be subject to import restrictions, licensing requirements, or regulatory limitations in certain jurisdictions. It is the customer’s responsibility to verify the legality and admissibility of the products in the destination country prior to placing an order. CADS shall not be liable for delays, seizures, refusals, or other consequences resulting from regulatory or customs actions.

The risk of loss of or damage to the products shall pass to the customer upon delivery of the products to the carrier. Ownership of the products shall pass to the customer only after full payment of all amounts due in respect of the order has been received by CADS.

In the event that a shipment cannot be delivered and is returned due to reasons attributable to the customer, including refusal of delivery, failure to collect the shipment, or failure to comply with applicable import or customs requirements, CADS reserves the right to recover the costs incurred or to deduct such costs from any amounts to be refunded.

13. Right of Withdrawal

 

In accordance with applicable consumer protection legislation, customers have the right to withdraw from a distance contract within fourteen calendar days from the date on which the customer, or a third party designated by the customer, acquires physical possession of the products. To exercise the right of withdrawal, the customer must notify CADS of the decision to withdraw within the applicable period, using the contact details published on the website. The products must be returned without undue delay and in accordance with the return instructions communicated by CADS.

14. Exclusions from the Right of Withdrawal

 

The right of withdrawal does not apply to products which, by their nature, are not suitable for return due to health protection or hygiene reasons and have been unsealed after delivery. This includes, without limitation, sealed products that have been opened, filters, cartridges, consumables, survival food, perishable items, and products intended for personal safety or hygiene once unsealed or used. Products showing signs of use, alteration, or damage may be refused and returned to the customer at the customer’s expense.

15. Refunds and Reimbursements

 

Where a withdrawal is accepted, CADS shall reimburse the customer for the price paid for the products, excluding delivery costs, without undue delay and in accordance with applicable law. Refunds shall be made using the same means of payment used by the customer for the initial transaction, unless expressly agreed otherwise. CADS reserves the right to withhold reimbursement until the returned products have been received and inspected.

16. Warranties and Disclaimer

 

Products are subject to the statutory warranties provided under applicable law. Except as expressly provided by law or stated in the product documentation, CADS makes no additional warranties, express or implied, regarding the products, including any warranties of fitness for a particular purpose or expected performance in specific conditions. Any statements regarding the characteristics or capabilities of products are limited to those expressly set out in the applicable product documentation.

17. Limitation of Liability

 

To the maximum extent permitted by applicable law, CADS shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the purchase or use of the products. The total liability of CADS, whether in contract, tort, or otherwise, shall in all circumstances be limited to the total amount paid by the customer for the products giving rise to the claim. Nothing in these Conditions of Sale shall limit or exclude liability where such limitation or exclusion is not permitted by applicable law.

18. Force Majeure

 

CADS shall not be liable for any failure or delay in the performance of its obligations under these Conditions where such failure or delay results from events beyond its reasonable control.

Force majeure events include, without limitation, natural disasters, acts of war or terrorism, governmental actions or restrictions, pandemics, strikes or labor disputes, supply chain disruptions, port or airport congestion, customs controls, transportation failures, power outages, or failures of communication networks.

The occurrence of a force majeure event shall not entitle the customer to claim damages. CADS shall be entitled to suspend performance of its obligations for the duration of the force majeure event and to resume performance once the effects of such event have ceased.

19. Amendments to the Conditions

 

CADS reserves the right to amend, modify, or update these Conditions of Use and Sale at any time, without prior notice, in order to reflect changes in legal requirements, business practices, or the structure and operation of the website.

The version of the Conditions in force at the time an order is placed shall govern that order. Continued access to or use of the website after the publication of updated Conditions shall constitute acceptance of the revised Conditions.

20. Governing Law and Jurisdiction
